Triumphal Tour Terms of Sale
Preamble
TRIUMPHAL TOUR, a French limited liability company (SARL) registered with the Paris Trade and Companies Register under number 992 255 877, with its registered office at 1 rue Mizon – 75015 Paris, offers private touring experiences aboard classic sidecars with a rider-guide, departing from within the Paris city limits.
These Terms of Sale (hereinafter the “Terms”) set out the rights and obligations of TRIUMPHAL TOUR and of any natural or legal person booking a service offered by the Company, whether that booking is made directly on the TRIUMPHAL TOUR website, by telephone, by email, through a commercial partner or via an online booking platform (OTA).
TRIUMPHAL TOUR designs each of its services as an exclusive, personalised touring experience, combining discovery of Parisian heritage, comfort and excellence of service. These Terms form part of that commitment to transparency and are intended to ensure a clear, balanced and secure contractual relationship between the parties.
Article 1. Designation of the parties
These Terms of Sale set out the rights and obligations of TRIUMPHAL TOUR and of any natural or legal person booking a service (hereinafter the “Customer”).
The term “Customer” refers to any natural or legal person entering into a contract with TRIUMPHAL TOUR, whether the booking is made on their own behalf or on behalf of third parties who will benefit from the services.
Article 2. Content of the services
By accepting these Terms of Sale, customers expressly acknowledge that they have been informed that the services provided by TRIUMPHAL TOUR are passenger transport services aboard a sidecar.
Consequently, the services provided are legally governed by the statutory provisions applicable to passenger transport contracts in force on the date these Terms of Sale are accepted.
In this respect, and in order to evidence its compliance with the applicable regulations, TRIUMPHAL TOUR declares that it holds all the authorisations, licences and approvals required for the carriage of passengers for hire or reward.
TRIUMPHAL TOUR holds the mandatory statutory guarantees applicable to passenger transport contracts and declares that it has taken out the following insurance: three-wheeled vehicle transport insurance and professional civil liability insurance.
The insurance cover does not extend to damage resulting from wrongful or dangerous conduct by the Customer, or from conduct contrary to the safety instructions.
Transport includes pick-up at a location chosen by the customer (within the Paris city limits) and return to a location also chosen by the customer (within the Paris city limits) at the time of booking (inner and outer suburbs: please contact us).
The transport service is provided by a private rider and may, as an ancillary, be accompanied by an optional service ordered at the time of booking.
Article 3. Pick-up and return
Unless special conditions are expressly agreed at the time of booking, TRIUMPHAL TOUR's services include picking up the Customers at, and returning them to, the address given at the time of booking, provided that this address is located within the Paris city limits.
Requests for pick-up or drop-off in the inner or outer suburbs may be considered on prior request. They are subject to operational feasibility and may give rise to an additional charge, which will be communicated to the Customer before the booking is confirmed.
Any change to the pick-up or return location requested after the booking has been confirmed remains subject to the prior agreement of TRIUMPHAL TOUR and may result in an adjustment to the price or the schedule.
Article 4. Booking / payment of the deposit
4.1 Bookings by private individuals
For any booking made by a private individual on the TRIUMPHAL TOUR website, payment in full for the service is required when the order is confirmed.
For a booking made directly with TRIUMPHAL TOUR (by email, telephone, WhatsApp or any other means of communication), the booking becomes firm once confirmed by TRIUMPHAL TOUR.
Where such confirmation takes place five (5) calendar days or fewer before the date of the service, payment in full is due immediately and is retained by TRIUMPHAL TOUR in the event of cancellation by the Customer.
4.2 Bookings by professional customers
For any booking made by a professional customer (companies, travel agencies, concierge services, tour operators or any other commercial partner), a deposit of 40% of the total price of the service including VAT is required when the booking is confirmed.
Payment of this deposit is an essential and decisive condition of the formation of the contract. If it is not received within the agreed period, TRIUMPHAL TOUR reserves the right not to confirm the booking and cannot guarantee the availability of the vehicles, the rider-guides or the requested time slot.
Unless special conditions are agreed in writing between the parties, the balance of the price is payable no later than before the start of the service, in accordance with the terms stated on the booking confirmation or the invoice.
Article 5. Changes and cancellation
5.1 Cancellation or change at the initiative of TRIUMPHAL TOUR
TRIUMPHAL TOUR reserves the right to change, postpone or cancel a service where it cannot be performed under satisfactory conditions of safety or quality, in particular owing to a technical constraint, exceptional weather conditions, a decision of the public authorities, an event of force majeure or any other circumstance beyond its control.
In such a case, TRIUMPHAL TOUR will endeavour to offer to postpone the service to a date agreed with the Customer. Where postponement is not possible, the sums already paid for the cancelled service will be refunded in full, and no further compensation may be claimed.
5.2 Partial cancellation at the initiative of the Customer
Any reduction in the number of vehicles booked is treated as a partial cancellation. The following conditions apply:
- More than five (5) calendar days before the date of the service: a cancellation fee of 10% of the price of each cancelled vehicle will be charged.
- Five (5) calendar days or fewer before the date of the service: 100% of the price of each cancelled vehicle remains payable to TRIUMPHAL TOUR.
5.3 Full cancellation at the initiative of the Customer
Any cancellation of the entire booking is subject to the following conditions:
- More than five (5) calendar days before the date of the service: a cancellation fee of 10% of the total price of the booking will be charged.
- Five (5) calendar days or fewer before the date of the service: 100% of the total price of the booking remains payable to TRIUMPHAL TOUR.
5.4 Postponement of a service
Any request to postpone a confirmed service must be sent to TRIUMPHAL TOUR as soon as possible. It remains subject to the prior agreement of the Company and to the availability of the vehicles, the rider-guides and the requested time slots.
Where a postponement is accepted, an administration fee of 50% of the price of the postponed service including VAT may be applied.
However, TRIUMPHAL TOUR reserves the right, as a commercial gesture and at its sole discretion, to reduce or waive all or part of this fee, in particular depending on the circumstances, the notice given and availability.
Article 6. Interruption
Any interruption of the tour during the service at the customer's request shall not give rise to any refund.
The management reserves the right to change or cancel the excursions offered where the comfort or safety of customers, or a technical constraint, so requires.
The Company shall in no event be liable for traffic congestion, delays, irregularities, strikes, weather conditions, accidents, serious injury, lateness, or theft or loss of belongings.
Article 7. Weather conditions
Services are performed except in exceptional circumstances that make travel dangerous or impossible. Ordinary bad weather, including rain, cold, wind or high temperatures, does not constitute grounds for cancellation or refund.
The sidecars are equipped to allow services to take place in normal weather conditions. We provide blankets to protect against the cold and ponchos to protect against the rain.
However, where weather conditions present a genuine risk to the safety of the passengers or the rider (storm, exceptional weather warning, black ice, snow, flooding or any other comparable event), TRIUMPHAL TOUR may decide to cancel the service or postpone it to a later date, at no additional cost to the Customer.
This decision is taken solely in the interest of the safety of the participants.
Article 8. Liability
TRIUMPHAL TOUR is bound by a best-efforts obligation in the performance of its services.
The Company exercises all the diligence reasonably expected in order to ensure the quality, safety and smooth running of the experiences it offers.
It shall not be held liable for any delay, change of route or non-performance resulting in particular from:
- traffic conditions;
- a decision of the public authorities;
- an exceptional event;
- an event of force majeure;
- the act of a third party;
- the delay or cancellation of the Customer's flight;
- the cancellation of the Customer's trip;
- the illness of one of the passengers;
- a breach attributable to the Customer;
- or the global geopolitical situation.
TRIUMPHAL TOUR shall not be held liable for the loss, theft or damage of personal belongings brought along by Customers during the service. It is the Customer's responsibility to take personal care of their valuables.
Article 9. Liability of the Customer
The Customer undertakes to use the equipment and vehicles made available to them with the greatest care and to comply at all times with the instructions given by the rider-guide.
Any damage caused to the sidecar, its equipment or any other property belonging to TRIUMPHAL TOUR, resulting from fault, negligence, improper use or failure to comply with the safety instructions on the part of the Customer, shall engage the Customer's liability.
In such a case, TRIUMPHAL TOUR reserves the right to ask the Customer to reimburse the cost of repairing or replacing the damaged equipment, on presentation of the corresponding supporting documents, without prejudice to any other action or compensation that may be due.
Article 10. Complaints
Any complaint relating to a service must be submitted as soon as possible and, at the latest, within 15 days of the date on which the service was performed.
Complaints must be made in writing, with acknowledgement of receipt, to the following address: TRIUMPHAL TOUR — 1 rue Mizon — 75015 Paris.
TRIUMPHAL TOUR undertakes to examine each request diligently and to seek an amicable solution as soon as possible.
